Plaintiffs’ Post-Hearing Memorandum
Now comes Plaintiff, The Center Street Historical District Association, by and through its undersigned counsel, and hereby submits the following memorandum for the Court’s consideration. As the Ashland County Historical Society has correctly asserted, the Court, in determining whether issuance of a Preliminary Injunction is proper, shall consider the following four factors: 1) the probability that Plaintiff can prevail on the merits of their complaint; 2) whether any harem likely to result to Plaintiffs from denying the Preliminary Injunction would be irreparable; whether the broader public interest would be served by granting the Preliminary Injunction; and the severity and nature of any harm that would likely come in others by the granting of the preliminary Injunction. Absent an abuse of discretion, the decision of the Trial Court will not be disturbed on appeal. King’s Welding & Fabrication vs. Richard King, 2006 Ohio 5231 (2006).
